When you engage with us, we may collect certain information from you. This Privacy Policy is designed to tell you how we may collect your Personal Information (as defined below), and how we may use your Personal Information in connection with the products and services we provide.

  • “Personal Information” is defined differently by different privacy laws and generally means any information that identifies, relates to, describes, references, or is reasonably capable of being associated with or linked to an identified or identifiable natural person or in some cases, household.

Our “Services” are made up of www.maximcrane.com, and all related websites, mobile apps, products or programs offered or owned by the Company.

SCOPE OF THIS POLICY

This Privacy Policy explains how Maxim Crane collects, uses, and shares Personal Information about you when you use our Services or otherwise interact with us.

I. Information We Collect

We may collect or receive the following categories of information about you that can personally identify you – either on its own or when combined with other information. How we collect or receive this information depends on the context, such as the Services you use, your device or browser settings, or your account settings.

Not all categories of information will be collected or received about every individual.

The following is a list of categories of Personal Information which may have been collected from consumers or users of our Products within the last twelve (12) months. The categories and examples provided in the chart below are those defined in the California Consumer Privacy Act (“CCPA”). This does not mean that all examples of that category of Personal Information were in fact collected but reflects our good faith belief to the best of our knowledge that some of that information may have been collected about consumers. We will update this disclosure from time to time as appropriate.

J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)).Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.
K. Inferences drawn from other Personal Information.Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

A Note on Sensitive Personal Information

Sensitive Personal Information is broadly defined under different data privacy laws and may include:

  • Your racial or ethnic origin
  • Your political opinions
  • Your religion or other beliefs
  • Your health, biometric or genetic characteristics
  • Any trade union membership
  • Your sexuality (information about your sex life or sexual orientation)
  • Any criminal background
  • Precise geolocation
  • The content of your private communications (other than messages you may send to us)

Maxim Crane does not wish to collect most categories of SPI. We will only collect sensitive Personal Information for the purposes and in the manner allowed by law or with your consent, where permitted by law.

II. How We Collect Your Personal Information

Generally, there are three ways we collect your Personal Information:

A. Information You Provide to Us

We may collect the following information directly from you when you:

1. Engage with Us.

We collect information you directly provide to us when you engage with any of our Services, for example, when you visit one of our locations or attend an event, engage with our websites or digital properties, request a quote, register an account with us; subscribe to a newsletter or when you participate in a contest, promotion, or survey, or fill out a webform.

Depending on the context, this information may include:

  • Contact information such as name, email address, postal address, and telephone number(s)
  • Payment and transaction information including credit or bank card information so we may charge you for applicable Services
  • Account information and log in credentials, including unique identifiers such as username and password. When you register with us, we assign you a unique identifier, which helps us recognize you when you are logged in.
  • Usage, viewing, technical, and device data when you visit our sites, use our applications on third-party sites or platforms, or open emails we send, or connect with our wireless Internet access services and other similar technologies, including your browser or device type, unique device identifier, and IP address;
  • Location information, including approximate location information provided by a mobile or other device interacting with one of our sites, applications or physical properties, or associated with your IP address or other online or device identifier, where you have allowed us to process this information;
  • Still or video images captured by cameras or readers on or around our physical properties;
  • Call recordings when you call our phone numbers.

2. Engage with Us via a Chat Bot

By using our website’s chat features, including automated chatbots, you consent to the collection of information you provide, such as your name and contact details. Chat sessions may be recorded or transcribed for follow-up, training, quality control, service improvement, and other lawful purposes. Additionally, interactions may be shared with third parties through tracking technologies. By engaging with the chat, you agree to the recording, use, and sharing of your information as outlined in our Privacy Policy. If you do not consent, please refrain from using the chat. Continued use implies acceptance of these terms.

3. Sign Up to Receive Text Messages

We do not currently offer text message (SMS) communications. In the future, we may offer the option to sign up for text message updates, including account notifications, promotional offers, and event updates. If we introduce text message communications, we may collect your name, mobile number, and other information provided in the form, as well as any data you send via text, subject to your consent where required by law. You can opt out at any time by replying “STOP.” We will only send texts if you’ve opted in or as allowed by law for transactional communications where you’ve provided your mobile number. We will update this Privacy Policy if text message communications become available.

4. Share Content with Us

We offer you the ability to post content in certain contexts, or to share information with us that is held on other platforms. This information may include:

  • User-generated content such as communications and opinions in chat rooms, message boards, forums, surveys, polls, and online forms.
  • Any additional information we collect with your consent.

B. Information We Collect Automatically.

1. Trackers and Identifiers.

We collect tracking information about you when you visit or use our sites and applications on any device, whether or not you are logged in or registered, through a variety of technologies, such as cookies, Flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons.

The tracking data may be used for different purposes including, for example:

  • Usage Information: We may track, collect, and aggregate information such as which pages you visited, the order and timing of your visits, and which hyperlinks you clicked. We also collect information from the URLs that referred you to our sites. This may include logging your IP address, operating system, browser software, device identifiers, and advertising identifiers.
  • Targeted Advertising: Our site uses first-party cookies essential for functionality and may also use third-party cookies, such as LinkedIn and Google Pixel. These trackers may collect Personal Information to deliver relevant marketing and advertising on our site and third-party platforms. We may share limited Personal Information, such as identifiers or hashed email addresses, with social media and other platforms, which use this data to display our ads, find potential audiences, limit ads for you, and provide insights to improve our advertising targeting.

C. Information We May Collect from Other Sources.

We may acquire information from other trusted sources to update or supplement the information you provide or we collected automatically. The sources of this Information may include:

  1. Publicly available sources. As permitted by law, we may collect information from public websites, databases, court records, etc. such as contact information, demographic and professional data and interests.
  2. Social Media Platforms. When you engage with us on social media platforms (like Facebook or Instagram) or log into your account using social media credentials, we may access information such as your profile name, email address, friend/follower lists, demographic details, activities (likes, shares, comments), location, and reactions to our services. Additionally, if you’re logged into your social media account while using our services, the platform may track your activity. Please review the privacy policies of the relevant social media platforms for their practices and instructions on managing your privacy settings.
  3. Advertising Partners and other Third Parties: Advertisers, marketing companies, data analytics companies, and data brokers may share information about you with us that is derived from privately-owned databases give us access to a range of information sources — like publicly available data, government data, survey data, and more. This data may include your mailing address, your gender, your age, your household income, and other demographic data.

III. Use of Your Personal Information by Maxim Crane and its Brands

Maxim Crane, including its brands and affiliates, may use your Personal Information for the purposes described in this Policy. Consistent with applicable law and choices and controls that may be available to you, we may use information collected from you or from devices associated with you to:

  1. To provide and manage the Services. To provide you with the experiences, products, and services that you request, view, or engage with.
  2. To contact you. We may communicate with you about your account or transactions with us, and send you information or request feedback about features on our sites and applications or changes to our policies. We may also send you emails, newsletters or alerts or notify you of promotions, contests, surveys or events we think may be of interest to you.
  3. To improve or develop our Services. We may use your Personal Information to operate, understand, optimize, develop, or improve our sites, applications, products, services and operations, including by using analytics tools.
  4. Targeted Advertising. We may use your Personal Information to market our Services to you, including providing you with targeted advertising. We may serve you ads through websites, locations, platforms, and services that are owned and operated by third parties. Sometimes we use marketing vendors to advertise to you on our behalf. We may send you targeted or promotional emails.

  6. To detect fraud. We may use your Personal Information to detect, investigate and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal.
  7. For legal reasons or to carry out administrative tasks. We may use the information you provide to us to audit our internal processes for legal, regulatory and contractual compliance requirements, and for security and fraud detection purposes.
  8. With your consent. We may use your Personal Information in other ways with your consent or at your direction, unless applicable law prohibits using certain types of Personal Information even with consent.

IV. Sharing Your Personal Information with Other Entities.

We may share your Personal Information as follows:

  1. Within our company: We may share your Personal Information within our Company, including with our related brands and affiliates.

We require service providers to comply with applicable laws in using Personal Information.

  3. When Required by Law or as Necessary to Protect our Users or Services. We may disclose your Personal Information as is necessary or appropriate to protect, enforce or defend the legal rights, privacy, safety, or property of the Services, our employees or agents or users, or to comply with applicable law or legal process, including to respond to requests from public or government authorities.
  4. In Connection with a Corporate Transaction or Bankruptcy. We may disclose and/or transfer your Personal Information to a third party in the event that we sell or transfer all or a portion of our business or assets to that third party, such as in the event of or in contemplation of a merger or acquisition or in connection with a bankruptcy reorganization.
  5. At Your Direction. We may disclose your Personal Information when you direct us to share it with third-party sites or platforms, such as social networking sites.

Please note that, except as otherwise stated above, once we share your Personal Information with another company in the above circumstances, the information received by the other company is controlled by that company and becomes subject to its privacy practices.

V. Your State Privacy Rights

Maxim Crane may operate in states that provide residents with certain privacy rights.

If you reside in California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, this section may apply to you. Depending on your state, you may have (and we will honor to the extent applicable) the following data subject rights:

Limit Use and/or Disclosure of Sensitive Personal InformationCertain categories of Personal Information that we collect and use might be “sensitive” under data privacy laws. Consistent with applicable law, you may limit certain uses or disclosures of your Sensitive Personal Information and may exercise this right by emailing us at privacy@maximcrane.com.
Right to AccessConsistent with applicable law, you may submit a verifiable consumer request to access, in a portable and (if technically feasible) readily-usable form, the Personal Information that we have collected about you as well as more information about our data practices. For more information about how we collect, use, and disclose Personal Information for business purposes, please review the How We Collect Your Personal Information; Use of Your Personal Information by Maxim Crane and its Brands; and Sharing Your Personal Information with Other Entities sections of our Privacy Policy.
Right to CorrectConsistent with applicable law, you may submit a verifiable consumer request to correct inaccuracies in your Personal Information held by Maxim Crane.
Right to DeleteConsistent with applicable law, you may submit a verifiable consumer request to delete your Personal Information.
Sale and Sharing of DataWe do not sell Personal Information to third parties; we are not data brokers and do not put Personal Information on the open market. We do not knowingly sell or share the Personal Information of individuals who are younger than 17. We do allow third parties to collect Personal Information through the Maxim Crane platform and share Personal Information with third parties for the business purposes described in this Privacy Policy including, without limitation, advertising and marketing on the Maxim Crane Platform and elsewhere based on users’ online activities over time and across Maxim Crane’s, services, and devices. Consistent with applicable law, you may opt out of such processing by emailing us at privacy@maximcrane.com.
Right of Non-DiscriminationWe will not discriminate against you for exercising your rights and choices, although some of the functionality and features available on the service may change or no longer be available to you. Any differences in the services are related to the information provided.
Data Retention

We retain Personal Information for as long as needed or permitted in light of the purpose(s) for which it was collected. The criteria used to determine our retention periods include:

  • The length of time we have an ongoing relationship with you and provide services to you (for example, for as long as you have an account with us or keep using our services) and the length of time thereafter during which we may have a legitimate need to reference your Personal Information to address issues that may arise;
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or
  • Whether retention is allowed by applicable law (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).
De-IdentificationConsistent with applicable law, we may maintain and use anonymized information in de-identified form and not to attempt to re-identify the information, except that we may attempt to re-identify the information solely for the purpose of determining whether its de-identification processes satisfy the requirements of the CCPA.
Appeal of Consumer Rights RequestsTo appeal a refusal to take action on your request, please see the instructions in our response to your request or submit your appeal in writing by contacting us at privacy@maximcrane.com with the subject “Appeal of Consumer Rights Request.”
Use of Opt-Out SignalsWe do not sell Personal Information. However, we do process Personal Information for purposes of displaying advertisements that are selected based on users’ online activities over time and across different sites, services, and devices. We also engage in automated processing that could affect you. Consistent with applicable law, you may opt out of such processing by emailing us at privacy@maximcrane.com.
Right to Opt-Out for the Purposes of Profiling for Decisions That Produce Legal or Similarly Significant EffectsConsistent with applicable law, you may have the right to opt-out of processing of Personal Information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects. To exercise any right you may have, please email us at privacy@maximcrane.com.
Sensitive Data InferencesWe may process inferences from your sensitive data for the purposes discussed in our Privacy Policy. In the event that we do, we will retain the inferences until we have fulfilled the purpose for which we collected them. We will delete such inferences in accordance with our Privacy Policy.

Do Not Track and Global Privacy Settings

Some browsers and browser extensions support the Global Privacy Control (“GPC”) signal, which allows users to opt-out of certain types of data processing, including the sale of personal data, at the browser level. This eliminates the need to opt out on each individual website. When we detect a GPC signal, we will make reasonable efforts to respect your choices as indicated by the GPC setting, in accordance with applicable law. Currently, only certain browsers and browser extensions support GPC (see https://globalprivacycontrol.org/ for a list of supported browsers and extensions). We honor GPC signals as required by law.

“Do Not Track” (DNT) is a privacy preference you can set in your browser if you do not want online services to collect and share certain kinds of information about your online activity from this party tracking services. We respond to DNT signals and follow the W3C standard for responding to DNT signals. If you would like to set your browser to signal that you would not like to be tracked, please check your browser’s documentation for how to enable that signals. A. Other State Rights

CALIFORNIA “SHINE THE LIGHT” LAW/YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits consumers who are California residents, to request and obtain from us once a year, free of charge, information about the categories of Personal Information (as defined in the Shine the Light law), if any, that we disclosed in the preceding calendar year to third parties for those third parties’ direct marketing purposes. Our disclosure requirements apply only if we share our consumers’ Personal Information with third parties for them to directly market their own products to those consumers, instead of assisting us with our own business. VI. How to Exercise Your Privacy Rights

We provide you with a variety of ways to control the Personal Information we hold about you, including choices on how we use that information.

  1. Account Settings. You may access, modify or delete your account, update your subscriptions and email newsletters associated with that account by emailing privacy@maximcrane.com.
  2. Communication Preferences. You can unsubscribe from email, mail, telephone and text message communications from us. To do so, call us at (412) 504-0200 or email us at privacy@maximcrane.com.
    1. For email requests, it may take up to ten days for us to process your requests. For requests related to telephone calls, text messages, mobile service notifications it may take up to 30 days. If you adjust your postal mail preferences, it may take six to ten weeks before you stop receiving mail because postal mailings are prepared many weeks in advance.
    2. Regardless of your marketing communication preferences, we may still contact you for transactional or informational purposes, such as customer service, reminder or service notices, recalls, or information regarding your subscription or order(s).
  3. Opt-Out of Targeted Advertising. We may use your Personal Information for targeted advertising purposes, as described above. To opt-out of targeted advertising or manage your preferences email us at privacy@maximcrane.com.
  4. Cookie Controls. Most web browsers are set to accept cookies by default. If you prefer, you can go to your browser settings to learn how to delete or reject cookies. If you choose to delete or reject cookies, this could affect certain features or services of our websites. If you choose to delete cookies, settings and preferences controlled by those cookies, including third party targeted advertising preferences, may be deleted and may need to be recreated.
  5. Global Privacy Settings. Some browsers and browser extensions support the Global Privacy Control (“GPC”) that can send a signal to the websites you visit indicating your choice to opt-out from certain types of data processing, including data sales. When we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC setting as required by applicable law.
  6. Access, Correct, Delete or Restrict Processing of Your Personal Information. In some jurisdictions, you may have the right to access, modify or delete the Personal Information that we have about you. To exercise any of the rights described above, please submit a verifiable consumer request to us by emailing us at privacy@maximcrane.com. You may only make a verifiable consumer request for access or data portability twice within a twelve (12) month period.
  7. Other State-Specific Privacy Rights. If you reside in a state with a state privacy law, you may have additional privacy rights. Our State Data Privacy Rights section to this Privacy Policy includes instructions on how you may exercise those rights.
  8. Verification & Authorized Agents. You may use an authorized agent to submit verifiable consumer requests on your behalf. An authorized agent is a natural person or a business entity that you have authorized to act on your behalf. We will take reasonable steps to verify your identity and requests, including by verifying your account information, residency or the email address you provide. If you are an authorized agent submitting a request on behalf of another individual, we may require proof of your written authorization before processing the request. We may deny a request from an authorized agent that does not submit proper verification proof.
  9. Exempt Information. Certain information may be exempt from such requests under applicable law such as information we retain for legal compliance and to secure our Services. We may need certain information in order to provide the Products or Services to you; if you ask us to delete it, you may no longer be able to obtain the Products or use the Services.
  10. Non-Discrimination. You will not receive discriminatory treatment by use for the exercise of any of your privacy rights described herein.

VII. Children’s Privacy

Our websites, apps, and services are not intended for children under the age of 17, and we do not knowingly collect or solicit Personal Information from anyone under the age of 17. If you are under 17, please do not submit any Personal Information through our websites, apps, or other services. If we become aware that we have inadvertently collected Personal Information from a child under the age of 17, we will make reasonable efforts to delete such information from our records.

If you are a parent or guardian and believe that your child has provided us with Personal Information, you may contact us to review, delete, or withdraw consent for the collection, use, and/or disclosure of your child’s Personal Information as required by law. Parents and guardians may request that we delete or refuse further collection of their child’s Personal Information.

We are committed to protecting children’s privacy and complying with all applicable laws regarding the collection and use of Personal Information from minors.

VIII. Data Security and Retention.

The security, integrity, and confidentiality of your Personal Information are important to us. We have implemented technical, administrative, and physical security measures that are designed to protect guest information from unauthorized access, disclosure, use, and modification. Please be aware that, despite our best efforts, no security measures are perfect or impenetrable. We will retain your Personal Information for the length of time needed to fulfill the purposes outlined in this privacy policy unless a longer retention period is required or permitted by law.

IX. Other Important Legal Terms

The terms in this Privacy Policy and in our Terms of Use have legal importance and may be used by us in a legal proceeding, including to restrict certain claims by you or to limit your rights.

Specifically, in using our Services or accessing the Site you agree:

  1. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, WILL WE OR OUR SUBSIDIARIES, PARENT COMPANIES OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES THAT RESULT FROM OUR USE OF PERSONAL INFORMATION, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES, AND THE MAXIMUM AMOUNT OF DAMAGES FOR WHICH WE WILL BE LIABLE UNDER THIS AGREEMENT WILL BE THE GREATER OF THE FEES YOU PAID FOR ANY PRODUCT IN CONNECTION WITH WHICH YOU PROVIDED YOUR PERSONAL INFORMATION, OR $100.
